These Terms & Conditions apply to all garden design, landscaping, construction, planting and associated services provided by Leafscape Gardens.
By accepting a quotation, signing an agreement, paying a deposit or instructing Leafscape Gardens to commence work, the client agrees to these Terms & Conditions.

All quotations are based on the information available to us at the time the quotation is prepared.
Unless otherwise stated, quotations are valid for 30 days from the date of issue.
A quotation is based on the specific scope of Works described within it. Items not specifically included within the quotation are excluded.
We reserve the right to revise a quotation where circumstances materially change before the Works commence, including changes to material costs, supplier pricing, availability or the scope of the Works.
No Works outside the agreed quotation will be undertaken without the Client's agreement, except where reasonably necessary to protect the property, the Works or the safety of persons.
A contract is formed when the Client:
Acceptance of the quotation confirms that the Client has reviewed and accepted the scope of Works, price, payment terms and these Terms & Conditions.
The quotation, payment schedule, agreed specifications and these Terms & Conditions together form the agreement between Leafscape Gardens and the Client.
A deposit is required to secure the agreed start date unless otherwise stated in the quotation.
The deposit may be used to secure labour, order materials, reserve specialist subcontractors and prepare for the commencement of the Works.
A start date cannot be guaranteed until the required deposit has been received. Where materials are ordered specifically for the Client's project, the Client may remain responsible for the associated costs if the project is subsequently cancelled or postponed.
Payment terms will be set out within the individual quotation or payment schedule issued for the Project.
Where staged payments are agreed, each payment becomes due at the stage specified in the payment schedule.
Invoices and payment requests are payable by the date stated.
The Client must not withhold payment because of minor snagging items or works that do not materially prevent the garden from being used for its intended purpose.
Any agreed retention or final payment arrangement will be stated separately within the quotation or payment schedule.
If a payment is not received by the agreed due date, Leafscape Gardens reserves the right to suspend Works until the account is brought up to date.
Suspension of Works due to late payment may affect the original completion date and availability of labour or subcontractors.
Leafscape Gardens reserves the right to charge interest on overdue commercial debts where applicable under the Late Payment of Commercial Debts legislation.
Any reasonable costs incurred in recovering overdue sums may also be recoverable where permitted by law.
Changes to the agreed Works must be agreed before the additional or amended Works are undertaken.
Variations may include:
Where possible, Leafscape Gardens will provide the Client with the additional cost before the Variation is carried out.
Where immediate action is reasonably necessary due to an unforeseen issue affecting safety, drainage, structural stability or the protection of the property, we may undertake necessary remedial Works and discuss the associated costs with the Client as soon as reasonably practicable.
Landscaping involves working with existing ground conditions which cannot always be identified before excavation begins.
Unforeseen conditions may include:
Where such conditions require additional labour, materials, machinery or specialist services, these Works will be treated as a Variation.
Leafscape Gardens will discuss the issue and proposed solution with the Client before proceeding where reasonably possible.
The Client is responsible for informing Leafscape Gardens of any known underground services, pipes, cables, drainage or other installations within the working area.
Leafscape Gardens will take reasonable care when excavating but cannot accept responsibility for damage to unidentified or incorrectly positioned services.
Where appropriate, the Client may be required to provide utility plans or arrange specialist service detection before excavation begins.
Materials will be supplied in accordance with the quotation and agreed specification.
Natural materials including natural stone, timber and certain aggregates may vary in colour, texture, veining, grain, thickness and appearance. Such variations are inherent characteristics of natural products and are not considered defects.
Samples and photographs are intended as a guide only and cannot guarantee the exact appearance of the final material.
If a specified product becomes unavailable, discontinued or subject to substantial supplier delay, Leafscape Gardens will discuss suitable alternatives with the Client.
Alternative materials will not be substituted without the Client's agreement unless the original product is unavailable and an equivalent alternative has been expressly agreed.
Where the Client supplies materials or products, Leafscape Gardens cannot be responsible for defects, incorrect quantities, incompatibility, manufacturer issues or delays relating to those materials.
Additional labour caused by incorrect, damaged, missing or unsuitable Client-supplied materials may be chargeable.
The quotation will state whether waste removal and disposal are included. Additional waste created as a result of Variations or additional Works may incur additional charges.
Where hazardous, contaminated or otherwise unusual materials are discovered, specialist disposal may be required and will be treated separately.
The Client must provide reasonable access to the property throughout the Works. This includes access for:
The Client must ensure that agreed access routes remain available.
Where restricted access, parking restrictions or other site limitations materially increase labour, delivery or machinery requirements, additional costs may apply.
The Client is responsible for obtaining any parking permits, access permissions or similar arrangements unless otherwise agreed.
Our standard working hours are Monday to Friday, generally between 8:00am and 4:30pm.
Working hours may vary depending on the Project, site conditions, deliveries, weather and other practical considerations.
Noisy works will be carried out in accordance with applicable local restrictions.
Landscaping works are affected by weather and ground conditions.
Heavy rain, frost, extreme temperatures, high winds or other unsuitable conditions may require Works to be delayed or temporarily suspended.
Leafscape Gardens will take reasonable steps to minimise delays but cannot guarantee completion dates where circumstances outside our reasonable control affect the Project.
Other potential causes of delay include:
Where a delay occurs, we will communicate the revised programme as soon as reasonably practicable.
Where existing trees, plants, paving, walls, structures or other features are to be retained, Leafscape Gardens will take reasonable care when carrying out the Works.
However, existing features may have pre-existing defects, weaknesses or conditions that are not visible before work begins.
Leafscape Gardens cannot guarantee the survival or condition of existing plants or trees affected by excavation, changes in levels, drainage, construction or other unavoidable site conditions.
Where tree works are required, specialist arboricultural services may be recommended.
Plants are living products and their appearance, growth and survival depend on factors including weather, soil conditions, watering, maintenance, pests and disease.
Leafscape Gardens will provide planting in accordance with the agreed specification.
Unless an aftercare service is specifically included, responsibility for watering and ongoing maintenance passes to the Client following completion.
Seasonal availability may mean that certain plants cannot be supplied at the exact time requested. Where necessary, suitable alternatives will be discussed.
New lawns require appropriate watering, maintenance and establishment following installation.
The Client is responsible for following the aftercare instructions provided. Leafscape Gardens cannot be responsible for damage caused by insufficient watering, excessive use, pets, children, adverse weather or neglect following installation.
The Client will be notified when the principal Works have reached Practical Completion.
Minor outstanding items or snagging works will not prevent Practical Completion where the garden is substantially complete and usable.
Any snagging items identified will be recorded and addressed within a reasonable period, subject to material availability and suitable working conditions.
The Client must provide reasonable access for Leafscape Gardens to complete agreed snagging works.
Leafscape Gardens aims to deliver all Works to a professional standard.
Unless a different warranty is stated in the quotation, workmanship relating to hard landscaping is covered for 12 months from Practical Completion.
Manufacturer warranties apply separately to products and materials where such warranties are provided by the manufacturer.
The workmanship warranty does not cover:
Nothing in these Terms & Conditions affects any statutory rights the Client may have.
The Client acknowledges that gardens require ongoing maintenance.
This may include:
Unless expressly included within the quotation, ongoing garden maintenance is not included within the Works.
The Client agrees to:
The Client must not interfere with, alter or instruct third parties to alter Works while the Project is in progress without prior discussion with Leafscape Gardens.
Unless expressly included within the quotation, obtaining planning permission, building regulation approval, party wall agreements, listed building consent or other statutory approvals is the responsibility of the Client.
Where Leafscape Gardens identifies that permission or approval may be required, we will advise the Client where reasonably possible.
The Client should obtain appropriate professional advice where required.
If the Client cancels the Project after accepting the quotation and paying the deposit, Leafscape Gardens may deduct reasonable costs already incurred in connection with the Project.
These may include:
Any remaining balance of the deposit will be dealt with in accordance with applicable consumer law.
If the Client terminates the Project after Works have commenced, the Client remains responsible for payment for:
Leafscape Gardens will make reasonable arrangements to leave the site safe.
With the Client's permission, Leafscape Gardens may take photographs and videos of completed Works for use on our website, portfolio, social media and other marketing materials.
We will not publish the Client's name, address or other personal information without separate permission.
If the Client does not wish photographs to be used for marketing purposes, this can be agreed in writing.
Leafscape Gardens will carry out the Works with reasonable skill and care.
We will not be responsible for damage or loss arising from matters outside our reasonable control or from pre-existing defects, hidden conditions or unidentified underground services.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Leafscape Gardens may use suitably qualified subcontractors or specialist contractors where required to complete aspects of the Project.
Leafscape Gardens remains responsible for managing the agreed Works and coordinating subcontractors engaged by us.
Specialist services such as electrical work, tree surgery, plumbing or structural engineering may be carried out by appropriately qualified third parties where required.
If you have any concerns regarding the Works, please raise them with Leafscape Gardens as soon as reasonably possible.
We will review the concern and, where appropriate, arrange an inspection or agree a suitable course of action.
Clients are encouraged to allow Leafscape Gardens a reasonable opportunity to investigate and remedy any genuine workmanship issue before instructing another contractor to carry out remedial Works.
We aim to resolve any disagreement fairly and directly.
If a dispute cannot be resolved informally, both parties should consider appropriate alternative dispute resolution before commencing court proceedings where appropriate.
Nothing in these Terms prevents either party from exercising their legal rights.
Personal information provided by the Client will be handled in accordance with our Privacy Policy and applicable data protection legislation.
These Terms & Conditions are governed by the laws of England and Wales.
Any legal proceedings relating to the agreement will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that apply.
The quotation, agreed specification, payment schedule, approved drawings and these Terms & Conditions form the agreement between Leafscape Gardens and the Client.
If there is any conflict between these Terms & Conditions and a specific written agreement or quotation, the specific written agreement or quotation will take precedence for that particular matter.
Leafscape Gardens
