Terms & Conditions

These Terms & Conditions ("Terms") govern the agreement between Leafscape Gardens ("we", "us", "our") and the client ("you", "your") for all landscaping, design, and construction services.

By accepting a quotation, paying a deposit, or using our services, you agree to these Terms.

1. Definitions

  • "Services" – All landscaping, design, construction, installation, and related work carried out by Leafscape Gardens.
  • "Quote" / "Quotation" – A written price proposal outlining the agreed scope of work.
  • "Project" – The agreed work described in the quotation.
  • "Variations" – Any changes to the agreed project scope after acceptance.

2. Quotations & Validity

  • All quotations are valid for 90 days unless stated otherwise.
  • Quotations are based on the information available at the time.
  • Any undisclosed conditions (e.g., hidden pipes, poor sub-base, roots, drainage issues) may require adjustments to the quote.

3. Acceptance of Work

Work is accepted when:

  • You confirm the quotation in writing, and/or
  • You pay the required deposit

This creates a binding contract between you and Leafscape Gardens.

4. Deposits & Payments

  • A 40% deposit is required to secure booking and cover materials.
  • The remaining balance is payable in instalments depending on project length, as outlined in your quotation.
  • Full payment must be made upon practical completion.
  • Payments are accepted via bank transfer unless agreed otherwise.

Late Payments:

We reserve the right to apply late-payment charges or pause work if payments are not received on time.

5. Variations & Additional Work

Any changes requested by you after work begins must be agreed in writing. Variations may include:

  • Changing materials
  • Adding new features
  • Increasing quantities or work areas
  • Unexpected ground conditions

We will provide a revised quotation or variation order before proceeding.

6. Ground Conditions & Unforeseen Issues

You acknowledge that landscaping involves working with natural ground, which can reveal unforeseen conditions such as:

  • Concrete layers
  • Clay or unstable soil
  • Hidden utilities
  • Poor drainage
  • Tree roots
  • Sub-base failures

If such issues arise, we will notify you immediately and discuss solutions and cost implications.

7. Working Hours & Access

  • Our standard working hours are 8am–4pm, Monday–Friday.
  • You must provide reasonable access for workers, machinery, and materials.
  • Access delays caused by the client may incur additional charges.

8. Materials & Products

  • Materials may vary slightly in colour, texture, or finish due to natural variations.
  • If a product becomes unavailable, we may substitute it with a similar alternative of equal or higher quality, after consulting with you.

9. Waste Removal

All waste removal required for the project (e.g., grab lorries, skips) will be included in the quotation unless otherwise stated. Any excess waste created by additional work or variations may incur extra charges.

10. Delays

We are not liable for delays caused by:

  • Extreme weather
  • Supplier delays
  • Material shortages
  • Access restrictions
  • Variations requested by the client
  • Events outside our reasonable control

We will always communicate delays as soon as possible.

11. Cancellations

Before work begins:

  • If you cancel after paying a deposit, material and administrative costs may be deducted.

After work begins:

  • You will be responsible for all labour, materials, and costs incurred up to the cancellation date.

12. Quality & Warranty

We take pride in delivering durable, high-quality work.

  • Hard landscaping workmanship is covered by a 12-month warranty.
  • Manufacturer warranties apply to materials where provided.
  • Natural movement in materials (e.g., settlement, hairline cracks, efflorescence) is not considered a defect.

Warranty voids if:

  • The client or a third party alters the work
  • Damage occurs due to misuse or neglect
  • Natural events (subsidence, flooding, erosion) occur outside our control

13. Client Responsibilities

You agree to:

  • Provide accurate information before work begins
  • Keep pets and children away from work areas
  • Remove personal items that may obstruct work
  • Ensure access is available throughout the project

14. Liability

We are not responsible for:

  • Damage caused by pre-existing structural issues
  • Damage to underground services not accurately identified
  • Side effects of heavy machinery on weak driveways or lawns
  • Weather-related movement or natural aging of materials

Nothing in these terms limits liability for fraud or personal injury caused by negligence.

15. Photos & Marketing

With your agreement, we may take before-and-after photos of the project to use for portfolio, website, and social media marketing. We will never share your personal details or address.

16. Privacy

All personal information is handled in accordance with our Privacy Policy.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be handled under UK jurisdiction.
